The Controlled Substances Act of 1970 placed marijuana in the most restrictive use category, Schedule I, deeming it a drug with no medicinal value and high potential for abuse. To do clinical research with marijuana, you need a DEA license, and you need to get your study approved by the FDA. When it comes to actually obtaining research-grade marijuana, though, you have to go through the National Institute on Drug Abuse, a process that has proved problematic for some researchers determined to study the potential medical benefits of pot.

“In our case it took us 12 years to get approval from the Department of Health and Human Services,” said Brad Burge, director of communications for the Multidisciplinary Association for Psychedelic Studies, which privately funds studies of marijuana and other drugs, and sought to study the potential therapeutic benefits of smoked marijuana.

While anecdotal evidence suggests Charlotte’s Web can be highly effective in treating such conditions, scientific investigation of the product has been stymied by federal drug laws that severely limit marijuana research. Edward Maa, the principal investigator of the Charlotte’s Web study, says the new trial could be a first step toward building a body of research on how and why medical marijuana can be used to treat epilepsy. “This is the first attempt to get the information people are interested in that is observational in nature,” says Maa, an assistant professor at the CU School of Medicine and chief of the Comprehensive Epilepsy Programs at Denver Health.
